Acceptance of terms

Please read this agreement carefully before using the Tom Hixson & Co Ltd website as it contains information regarding your relationship with meatmeatsaintlouis.com and affects your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Tom Hixson & Co Ltd website. You are permitted to use the Tom Hixson & Co Ltd website solely on the basis of these terms. We reserve the right, at our discretion, to update and/or revise these Terms.

For the purpose of these Terms & Conditions the use of “We” and “Us” shall mean Tom Hixson & Co ltd

1. Use of Tom Hixson & Co website

1.1 The Tom Hixson & Co website is provided free of charge for you personal use subject to these Terms and Conditions. By using the Tom Hixson & Co website or by registering with the Tom Hixson & Co website you agree to be bound by these Terms and Conditions.

1.2 Subject to these Terms and Conditions, you are authorised to view and download our website for your personal use. We may change, suspend or discontinue the use of the website at any time, including the availability of any feature, database, or content. We may also impose limits on certain features and services or restrict access to parts or all of the services without notice or liability.

1.3 You shall be responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access or otherwise use the services, including, without limitation, modems, routers, hardware,  software, and long distance or local telephone services.

2. Amendments

2.1 We may update / change these Terms and Conditions from time to time. Any changes will be notified to you via the e-mail address you have provided on registration or a suitable announcement on the Tom Hixson & Co website. The changes will apply to the use of the Tom Hixson & Co website after we have given due notice. If you decide not to accept the changes to the Terms and Conditions you should not use the Tom Hixson & Co website. If you continue to use the Tom Hixson & Co website after the date on which the changes take effect then it will be deemed that you agree to be bound by the new Terms and Conditions.

3. Ordering

3.1 When you place your order on our website the value of your order is allocated to your credit / debit card or credit account if you have one. Due to the fact that a number of our products are weighted items the value of your order when placed may not be the true value charged at time of invoicing. The weighted item prices are average weight prices therefore when your order is collated the true value of those weighted items will be known and charged accordingly. A weighted item that weighs a little more than the stated average weight will cost a little more but also a weighted item that weighs a little less than the stated average weight will cost a little less.

3.2 The prices shown on the site at the time of ordering are guide prices. The prices charged will be the prices applicable at the time your order is collated and invoiced.

4. Delivery

4.1       Deliveries are by two methods. Orders under 40 kilo in weight will be delivered using a national courier. Orders above 40 kilo will be delivered by multi-temperature controlled vehicles.

4.2       All orders will require a signature on delivery.

4.3       Customers placing orders under 40 kilo have the option of specifying “Special Delivery Instructions” on completion of their order. This can be used to request an order be delivered to a neighbour or left in the shed or some other location in the event that at the time of delivery someone might not be available to sign for the delivery.

4.4       Should alternative delivery instructions be left our courier will carry out that request and leave a card to show that the order has taken place. When this has happened the ownership of the delivery will have passed to the customer as though they had signed for the delivery. Should the order go missing after the delivery has taken place then call customer services on 020 7248 3569. Tom Hixson & Co Ltd takes no responsibility for orders that have subsequently gone missing after delivery has taken place.

4.5       If no “Special Delivery Instructions” are requested and at the time of delivery there is no one available to sign for the delivery then our couriers will leave a card informing of a failed delivery and will return the delivery to their depot. The customer needs to follow the details on this card and contact the depot to arrange pick up or a subsequent delivery day. It is the customer’s responsibility to ensure this second delivery takes place within 24 hours to ensure that the products are delivered within temperature specifications. Tom Hixson & Co Ltd take no responsibility for orders delivered out of temperature due to a failed delivery

4.6       Customers placing orders of over 40 kilo must have someone available to sign for the delivery. No special delivery instructions will be taken into account as the order will only be delivered to the specified delivery address. Where the customer refuses or fails to take delivery of the goods then Tom Hixson & Co Ltd may at its option cancel the order or alternatively Tom Hixson & Co Ltd may at its option stand by the contract and shall be entitled at its option to suspend deliveries until the customer agrees in writing to take delivery and the customer shall in addition to the purchase price pay to Tom Hixson & Co Ltd all additional expenses incurred as a result of the delay including storage and until deliveries are resumed the goods which are the subject of the contract shall be stored at the cost and risk of the customer.

5. Returns / Cancellations / Refunds / Amendments

5.1 Due to the nature of our business and the laws governing fresh food, we are unable to accept returns. Should you have a problem with your delivery you will need to contact our help desk who can help you with your request.


5.2 If for whatever reason a refund is authorised the refund will be made onto either the credit / debit card the order was placed on or a credit will be processed onto the credit account if one exists with us. No cash refund will be made.

5.3 Cancellations or amendments to orders can be made within 24 hours of placing your order.

6. Registration

6.1 To register with Tom Hixson & Co Ltd you must be over eighteen years of age

6.2 You must ensure that the details you provide on registration are accurate and complete.

6.3 You must inform us immediately of any changes to the information provided by you on registration updating your personal details.

7. Security

7.1 When you register with Tom Hixson & Co ltd you shall be sent a temporary password to the email address you registered with. This temporary password allows you to access your account. You may change it to something more memorable if you wish. It is your responsibility to keep your passwords confidential and must not disclose it or share it with anyone else.

7.2 You shall be responsible for all activities and orders that occur or are submitted using your password.

7.3 If you know or suspect that someone else knows your password you should notify us by contacting customer services immediately.

7.4 If Tom Hixson & Co ltd has reason to believe that there is likely to be a breach of security or a misuse of the Tom Hixson & Co website then we may require you to change your password or we may suspend your account in accordance with paragraph below

8. Privacy Policy

9. Code of Conduct

9.1 You may not use any part of our site for any of the following purposes:- 

Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material.

Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practise.

Gaining unauthorised access to other computer systems

Interfering with any person’s use or enjoyment of the Tom Hixson & Co website.

Breaching any laws concerning the use of public telecommunications networks

Interfering or disrupting networks or websites connected to the Tom Hixson & Co website.

Making, transmitting or storing electronic copies of materials protected by copyright without permission of the owner.

9.2 Tom Hixson & Co Ltd reserves the right to remove any material already posted on its website or refuse to post any material on its website.

10. Promotional Offers

10.1 From time to time, Tom Hixson & Co Ltd may provide you with promotional codes by way of promotion or otherwise, which may be redeemed by you against a subsequent order placed on the Tom Hixson & Co website.

10.2 The promotional codes, when entered at the appropriate time during the ordering process, will activate the promotion for the corresponding promotional code and will immediately be shown in your shopping basket.

10.3 Failure to enter the correct code or an out of date code will not show anything up in your basket. Should you be having difficulty with a promotional code then please contact Customer Services before submitting your order.

11. Links

11.1 The Tom Hixson & Co website includes links to other websites or material which are beyond our control. Tom Hixson & Co ltd is not responsible for the content of these links, the internet, the World Wide Web or for sites outside Tom Hixson & Co. You therefore agree that Tom Hixson & Co Ltd having no control over such sites can not be held accountable for the availability of these pages.

12. Limitations & Liability

12.1 The Tom Hixson & Co website and any software is provided on an “AS IS” basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

12.2 Tom Hixson & Co ltd assumes no liability for any viruses or any other disabling features that affect your access to or use of the Tom Hixson & Co website.

12.3 Tom Hixson & Co ltd assumes no liability for any incompatibility between the Tom Hixson & Co website and other websites, services, software and hardware.

12.4 To the full extent allowed by law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Tom Hixson & Co website.

12.5 Nothing in this paragraph applies to Tom Hixson & Co Ltd’s liability in respect of products sold.

12.6 Nothing in these Terms and Conditions shall exclude Tom Hixson & Co ltd’s liability for personal injury or death caused by its negligence.

12.7 Our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order.

13. Intellectual Property

13.1 The content of the Tom Hixson & Co website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Tom Hixson & Co website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

13.2 You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Tom Hixson & Co website without prior written permission from Tom Hixson & Co Ltd. 

13.3 No Licence is granted to you in these Terms and Conditions to use any trade mark of Tom Hixson & Co ltd.

14. Suspension or cancellation of registration

14.1 Tom Hixson & Co ltd may suspend or cancel your registration at any time at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

14.2 You can cancel your registration and your right to use Tom Hixson & Co Ltd at any time by informing us in writing. If you do so you must stop using the Tom Hixson & Co website.

14.3 The suspension or cancellation of your registration and the right to use the Tom Hixson & Co website shall not affect either party’s rights or liabilities.

14.4 Paragraphs 8 and 9 of these Terms and Conditions shall remain in force after cancellation.

15. Miscellaneous

15.1 You may not assign, sub-license or otherwise transfer your rights under these Terms and Conditions

15.2 If any of these Terms and Conditions is found to be invalid by any court of law having competent jurisdiction, the validity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect and enforceable.

15.3 Tom Hixson & Co ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

15.4 If you breach these Terms and Conditions and Tom Hixson & Co ltd ignores this, Tom Hixson & Co ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach these Terms and Conditions.
